Terms of Service

1. Acceptance of Terms

By accessing or using OwnerBuilt ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all users, including visitors, registered users, and subscribers.

2. Description of Service

OwnerBuilt is a cloud-based construction project management application designed for owner-builders and self-managed construction projects. The Service includes tools for budget tracking, subcontractor management, bid comparison, schedule management, daily logging, issue tracking, document storage, and related features.

3. Account Registration

To use the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You must be at least 18 years of age to use the Service. By creating an account, you represent that you meet this requirement.

4. Subscription and Billing

OwnerBuilt offers paid subscription plans billed on a monthly or annual basis. Subscription fees are charged in advance. All fees are non-refundable except as required by applicable law or as expressly stated in these Terms.

Free Trial: New accounts receive a 14-day free trial with full access to all features. No credit card is required to start a trial. At the end of the trial period, continued access to write features requires a paid subscription.

Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. You will not receive a refund for the unused portion of a billing period.

Archive Mode: If your subscription lapses or is cancelled, your account automatically enters Archive Mode. In Archive Mode, all your data remains accessible in read-only format at no charge, indefinitely. No data is deleted due to subscription cancellation.

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law or regulation
• Upload or transmit any malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the integrity or performance of the Service
• Collect or harvest any personally identifiable information from the Service
• Use the Service for any fraudulent or deceptive purpose

6. Your Data and Content

You retain ownership of all data, documents, photos, and content you upload to the Service ("Your Content"). By uploading Your Content, you grant OwnerBuilt a limited, non-exclusive license to store, process, and display Your Content solely for the purpose of providing the Service to you.

We do not sell Your Content to third parties. We do not use Your Content for advertising purposes. You may export or delete Your Content at any time.

7. Intellectual Property

The Service, including its software, design, text, graphics, and other content (excluding Your Content), is owned by OwnerBuilt and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works of any part of the Service without our express written permission.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. OWNERBUILT DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

OwnerBuilt is a project management tool. We do not provide construction advice, legal advice, financial advice, or professional contracting services. All construction decisions remain your sole responsibility.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OWNERBUILT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

10. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the Service will cease. We will provide you with reasonable opportunity to export Your Content prior to termination, except in cases of serious violations.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or by a prominent notice within the Service. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the State of Colorado, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in Colorado.
